§ 1 Provider

§ 2 Scope

(1) These General Terms and Conditions (GTC) apply to all orders placed via the online shop vigo-rio.com to be completed.

(2) Any terms and conditions of the customer that deviate from these will not be recognized unless the supplier expressly agrees to their validity in writing.

(3) For the conclusion of contracts with consumers within the meaning of § 13 BGB These terms and conditions apply in accordance with the German Civil Code (BGB).

§ 3 Conclusion of Contract

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to submit an offer to purchase (§ 145 BGB).

(2) By clicking the “Buy now” button, the customer submits a binding offer to conclude a purchase agreement (§ 146 BGB).

(3) The supplier confirms receipt of the customer's order by means of an automatic order confirmation via email. This confirmation does not yet constitute acceptance of the purchase agreement, but merely informs the customer of the receipt of the order.§ 147 BGB).

(4) The contract shall be concluded exclusively in German or English, depending on the customer's choice.

§ 4 Delivery & Availability

(1) Delivery will be made to the delivery address specified by the customer (§ 433 BGBShipping usually takes place within 1-3 working days after receipt of payment, unless different delivery times are specified in the shop.

(2) The supplier delivers to customers within the European Union (EU) as in other international countriesA complete list of the countries we ship to is available in the shop.

(3) If a product ordered by the customer is not available at the time of the order, the supplier shall inform the customer immediately in accordance with Section 3 Paragraph 3 of the Civil Code.

(4) In the event of delivery delays of more than 14 days, the customer is entitled to withdraw from the contract (§ 8 BGBPayments already made will be refunded immediately.

§ 5 Prices & Shipping Costs

(1) All prices quoted in the shop include statutory VAT (Germany), according to Section 1 Paragraph 1 VAT Act (Value Added Tax Act).

(2) For deliveries to other countries, the value added tax will be adjusted according to the tax rate applicable there (Section 3 Paragraph 8 of the German VAT Act).

§ 6 Payment methods

The following payment methods are available:

  • Advance payment via bank transfer

The invoice amount is due immediately upon conclusion of the contract (§ 271 BGB).

§ 7 Retention of Title

The goods remain the property of the supplier until full payment is received.§ 455 BGB).

§ 8 Right of withdrawal

(1) Consumers have a statutory right of withdrawal of 14 days in accordance with § 355 BGB.

(2) The provider will make the complete cancellation policy and a sample cancellation form available separately in the shop (§ 357 BGB).

(3) The following are excluded from the right of withdrawal, among others: (Section 312g Paragraph 2 of the German Civil Code (BGB)):

  • Sealed goods that are not suitable for return for hygiene or health reasons if the seal has been removed.
  • Digital content upon full delivery.

§ 9 Warranty

(1) The statutory warranty rights apply in accordance with § 434 et seq. BGB for all products, except perishable or used goods.

(2) For entrepreneurs, the warranty period shall be 12 months from delivery, provided the goods are returned in accordance with § 377 HGB The defects will be inspected immediately and reported.

(3) For sealed goods or digital products, restrictions apply if the seal has been removed or the digital content has been fully provided.

§ 10 Liability

(1) The provider shall be liable for defects in accordance with the statutory provisions, in particular according to §§ 434 et seq. BGBThe supplier is not liable for damages resulting from incorrect handling or improper use of the product.

§ 11 Registration in the online shop and password protection

Customers have the option to register in the online shop to benefit from the advantages of managing a personal user account. Registration creates a user account that grants the customer access to certain shop features.

(2) Responsibility for access data:
The customer is obligated to keep their login details (username and password) confidential and to protect them from unauthorized access. The customer assumes full responsibility for all activities and orders carried out using their login details.

(3) Abuse and safety:
In the event of account misuse or suspected unauthorized access, the customer is obligated to inform the provider immediately.
